About This Event
Now in it's 5th year, we are moving our Dana Point Oktoberfest to the larger state of the art venue of SilverLakes in Eastvale / Norco, CA. This venue is surrounded by 1.6 million people and is visible from the I-15 freeway. The SilverLakes Oktoberfest will continue on with more of the same authentic German music, games, dancing, food and German and craft brews the event has become known for, but will expand with a Friday night opening and expanded hours on Saturday into the night.

TERMS & CONDITIONS
By signing this agreement, paying in full or in part and by EventWerks (Promoter) processing payment or payments, it is understood that this agreement is binding and that EventWerks has reserved space for your company (Exhibitor) at the event and that there are no refunds prior to the event or after for any reason whatsoever.
Exhibitor understands that by signing this agreement and by EventWerks accepting Exhibitor’s reservation, that EventWerks will do their best to provide maximum value to Exhibitor. If for any reason Exhibitor is not satisfied with the event, Exhibitor is to direct all comments and/or concerns to EventWerks at [email protected]
Please check event load-in instructions for load-in specifics. Exhibiting companies arriving after this scheduled time will be charged $50 and can be relocated to any location specified by EventWerks, or may forfeit their Event participation rights for that specific event.
Exhibitor shall fully indemnify, defend, and hold Promoter, EventWerks, Designated Charitable Organizations, City & Venue in which the event is held and all its managers, members, directors, oﬃcers, employees, agents, successors, and assigns, harmless from any and all losses, damages, expenses, claims, judgments, liabilities, suits, and proceedings of any nature, whether accrued, absolute, contingent or otherwise which arise from (i) Exhibitor’s breach of this Agreement, (ii) any damage or deficiency resulting from misrepresentation in or omission from any document, instrument, record, statement or certificate, furnished or to be furnished, to Promoter here-under, (iii) any act or omission of Exhibitor or any of its shareholders, directors, oﬃcers, employees, agents, successors, and assigns, and (iv) all actions, suits, proceedings, demands, assessments, judgments, costs and expenses incident to any of the foregoing. In addition, Exhibitor shall reimburse to Promoter, on demand, for any payment made by Promoter in respect of any liability or claim to which the foregoing indemnity relates.
If the event cannot take place, in whole or in part, because of an act of God, national emergency, war, labor dispute, fire casualty or other unforeseen occurrence or any other cause beyond the control of Promoter or which Promoter is unable to avoid by exercise of due diligence, Promoter shall have no obligation or liability whatsoever to Exhibitor as a result thereof and may re-schedule the event without refund to exhibitor during the period prior to the re-scheduled. Refunds will only take place in th case that the re-scheduled event does not take place within one calendar year from the originally scheduled date.
Exhibitor hereby assumes all costs and expenses arising from Exhibitor’s or Exhibitor’s agents’ or employee’s incorporation or use during the event of any music, written material, dramatic rights, inventions or devices that are subject of any copyright, trademark, trade name, patent, franchise or other contractual or statutory protection. Exhibitor agrees to indemnify and hold harmless Promoter, its directors, oﬃcers and employees from any claims, damages, costs or expenses, including legal fees, which might arise out of or in connection with
such incorporation or use. Promoter plans to document the Event through still photography as well as produce video / motion picture programming containing footage from the Event, which footage may contain Exhibitor’s name and logo, booth space, products or employees. Exhibitor consents to the use of the aforementioned in such still photography and video programming and the advertising and exploitation thereof in any and all media during or after the event, and notwithstanding anything to the contrary contained in this Agreement, Exhibitor hereby waives any approval rights with respect to such programming.
A) The Promoter shall have the full power in the interpretation and enforcement of all registration terms and any further stipulations considered necessary for the proper conduct of Event.
B) Exhibitor agrees to comply with all pertinent laws, codes and regulations of municipal or other authorities that affect the show space.
C) Sponsor Exclusivity: You may not display or sell products that compete with our sponsors. Please check with your sales representative for a complete listing of companies.
PROMOTER PROVIDES / BOOTH INCLUSION
Promoter does not provide tents, tables, chairs, electrical or any other amenity except for space at the events unless otherwise noted. Exhibitor must supply or source their own equipment, sales & health permits or anything else that may be required by law to operate at the events.
